Our approach is to provide each client with an aggressive representation, in order to secure the best possible results and complete compensation for their injuries.

If you or someone you know has been hurt in an accident or suffered a loss because of someone else’s carelessness, you are aware of how difficult the recovery process can be.  In most cases, people are injured because they just happen to be in the wrong place at the wrong time.  Sometimes it is impossible to get back all that you have lost, but the law may allow you to be compensated for your injuries.

In most instances, a person who is injured as a result of someone else’s negligence or wrongdoing can be compensated for their past and future medical expenses and lost wages, as well as for their pain and suffering, emotional distress, and loss of enjoyment of life.  Spouses of injured persons may also be entitled to recover for the loss of consortium with their loved one.

Every case is different and presents its own unique challenges – and therefore, it is important that you seek the advice of an attorney who is experienced in personal injury and negligence cases.  Edward J. If you have been injured in an accident, it is very important that you seek the immediate advice of an experienced personal injury attorney.  The law may provide you with certain protections, but those protections can be seriously affected and sometimes even lost, if you wait too long.

  1. Do not give any written or oral statements.  Soon after an accident occurs, it is common for an injured party to be contact by either their insurance company, or the insurance provider for the person who is responsible for the injured party’s injuries.  Often times, these statements are requested before an injured person has the chance to fully understand what happened, or even the extent of their injuries.  Nonetheless, once a statement has been made, insurance companies will use the information that they obtain to vigorously defend against the injured party’s claims and to deny paying compensation for the injuries the injured party sustained.
  2. Seek immediate medical assistance.  Even the slightest accident can cause serious injuries to the people involved.  For the safety and health of the injured party, any person who has been involved in an accident should seek immediate medical attention, in order to fully diagnose their injuries and also to prevent an insurance company from claiming that an accident victim’s lack of seeking medical attention is evidence of non-injury.
  3. Representation by an Attorney is vital.  Insurance companies will take advantage of accident victims who represent themselves by making lower settlement offers and quickly trying to get victims to sign a release before their injuries might have been fully and properly diagnosed.  Once an accident victim agrees to a settlement, they release the wrongdoer and their insurance provider from any and all further liabilities – even for injuries that were not yet discovered at the time of settlement.  An experienced personal injury attorney will be able to counsel an accident victim through this process.
  4. Once you hire an attorney, the insurance company must stop calling you.  Once an accident victim retains the assistance of an attorney, all insurance companies and investigators must stop contacting you, and deal directly with your attorney.
  5. No attorney fees are paid unless you recover.  In most cases, fees charged by an attorney in personal injury cases are based on a percentage of the amount that you recover for your injuries.  Therefore, if you are not compensated for your injuries, you will not owe any fees to your attorney for his or her assistance.  Furthermore, an experienced personal injury attorney will assist you in negotiating the amount of your medical bills – and Edward J. Witas & Associates, P.C. will pass 100% of the amount that we save onto the client.
